The Division was unable to locate the proof of notification for the following adjacent property
ownerslstructure owners:
Jose Lujan (Parcel 146936000030)
Weld County (roads and property west of Dersham)
~ Baseline Road1168!^ Ave. (please state the owner of this road)
Attached please find the return receipt of a Certified Mailing for Weld County. Weld County is the
owner of Baseline Road. Please note that we tried to contract Mr. Jose Lujan several times, but the
post office was unable to.deliver or forward the notice to him. I have attached proof of our attempts to
reach him. -
2. The applicant provided certified mail receipts indicating that Bestway Concrete Batch Plant and
Duke Energy were notified of the application. Please locate these structuresllandowners on the
map.
We have labeled the Bestway Concrete Batch Plant which is on the Baseline site. The title work
indicated that there may be a buried natural gas line in Section 36, Township 1 North, Range 67 West
(along with a myriad of other sections, townships antl ranges). Our research (including discussions
with the landowners, surveyor and title company) does not indicate that there is a gas line within 600
feet of the property. However, we sent the notice to Duke Energy as an abundance of caution. We
have also placed a note on the mining plan that the operator should locate all utilities prior to slurry wall
constmction or mining.
3. Please provide the notarized letter from the Dershams consenting to removelrelocate structures
within the mining limits. As an alternative, the operator can provide adequate mining offset
distances in accordance with Rule 6.4.19.
Attached please find the notarized letter from the Dershams consenting to removelrelocate structures
within the mining limits.
451 ^AK STREET, SII ITE 209 ~ P. ~.
