Squire <br />Feclamation Specialist <br />Mlined Land Reclamation Division <br />C+epartment of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />re: File No.: M-90-147, Mendota Properties, 110(2) Application <br />Dear Mr. Squire: <br />In response to the Clear Creek County letter dated 1/4/91 that <br />you received from Debra Kirkham, Zoning Specialist, we are <br />revising our permit application concerning future land use. <br />The current zoning is correct for our projected mining uses. We <br />do not feel that it is appropriate to leave the future use as <br />mining once the mining operation is completed, as that would <br />serve no practical purpose. The other use allowed by present <br />zoning is residential. Because of the property's close proximity <br />to I-70, and the physical layout of the property, we do not feel <br />that the property has any value as a residential site. <br />We believe that the highest and best use of the property upon <br />completion of mining will be commercial and industrial. For the <br />property to be utilized in that manner, it will require that we <br />apply for rezoning upon total exploitation of the mining utility. <br />To clarify our intent, as well as to answer the concerns of Clear <br />Creek County, I have modified our "Statement of Use" as it <br />appears on page 3 of our application presentation. I am <br />including two copies of the revised page 3 for your use, and will <br />deliver one copy to the Clear Creek County Clerk and Recorder for <br />inclusion in the public copy of the application. In addition, I <br />will personally deliver a copy of this letter along with the <br />application change to Debra Kirkham at Georgetown. <br />
