Cottony <br />Craig CO 81626 Division Director <br />ATTN: Mr. POrrest Luke Natural Resource Trustee <br />SUBJ: NOI CX-2005-189-006 Application Incompleteness <br />Dear Mr. Luke: <br />The Division has received your Notice of Intent to conduct coal exploration (NOI-2005- <br />189-06), submitted 29 August 2005, and has made the following findings: <br />The application is incomplete. <br />2. The project qualifies as coal exploration rather than coal mining. <br />3. Your project will substantially disturb the natural land surface. Therefore you will be <br />required to submit a bond to cover the cost of reclamation. The Division has received <br />the pertinent information and will calculate the bond liability. <br />The Division has several questions/comments on the application. <br />A. Because the azea of disturbance lies within the existing permit azea, no right-of- <br />access confirmation will be required. Please add to the map a permit boundary and, if it <br />falls within the scope of the map, the coal lease boundary. <br />B. Please provide USGS section-township-range boundaries on the map to enable DMG <br />personnel to reference the locations exclusive of Trapper Mining's in-house grid system. <br />C. Please add surface ownership boundazies to the map. <br />D. Please provide confirmation that cleazance has been obtained for all the disturbance <br />azeas regarding T&E species.
