Long <br />Division DveUOr <br /> <br />RE: Ferrero Pit (File M-2000-028) Results of adequacy review of 1 10 permit application <br />Dear Mr. Lewicki: <br />The Division has conducted a review of the permit application for the Ferrero Pit. The application is extremely well <br />done, however, the Division has identified the following adequacy concerns; <br />NOTICES: At [his time, there is no evidence with the permit application that the public notice required by <br />Rule 1.6.2 (1) (d) has been published. <br />Please provide evidence of compliance with the requivements of Rule 1.6.2 (1) (d) prior to the decision <br />date of April 7, 2000 in order that approval of the application may be considered at that time. <br />NOTICES: The Division is unable to locate evidence among the materials supplied with the application <br />that Mr. Mengatti, as owner of the surface and mineral rights to the land to be affected by the proposed mining <br />operation, has been advised of the application as required by Rulel.6.2 (I) (e) (i). <br />Please provide evidence of the required notification to Mr. Mengatti. <br />NOTICES: While the Division tends to believe that Mr. Mengatti owns all the surface lands within 200 <br />feet of the proposed permit area, this is not clearly stated in the application. <br />Please indicate if Mr. Mengatti owns all the surface land within 200 feet of the proposed permit boundary. <br />If not, please provide an Exhibit A Map or a revised Exhibit E-Mine Plan Map with the adjacent owners and then <br />property identified and evidence of notifying these adjacent land owners as required by Rule 1.6.2 (I) (e) (ii). <br />EXHIBIT A (Rule 6.3.3 (2)): Identification of adjacent surface land owners is missing. <br />See cortective action under NOTICES issue immediately above. <br />EXHIBIT C (Rule 6.3.3 Q)) The application indicates anon-discharging sediment pond will be <br />constructed to capture surface runoff from the site. The Office of the State Engineer, however, has required at times <br />that surface runoff not be retained longer than 3 days before release. <br />Please provide evidence of contact with the Office of the State Engineer and that the proposed retention of <br />surface runoff from the site in the sediment pond does not conflict with that Office's requirements. <br />EXHIBIT C (Rule 6.3.3 (k)): However unlikely it may be that any refuse or acid or toxic producing <br />materials will be exposed during the mining operation, Rule 6.3.3 (k) requires an applicant to describe how such <br />materials will be handled and disposed of in the event they are exposed. <br />Please indicate how any refuse or acid or toxic producing materials will be handled and disposed of in the <br />event such are exposed during the mining operation. <br />
