Long <br />Division Duecmr <br />On September 26, 1997, a water sample was collected by the Division of Minerals and Geology <br />(DMG) at the Seneca II-W Mine at Dischazge Point 006 from the emergency spillway and the <br />primary spillway. The Division recently received the analytical results from our private lab, <br />Analytica Environmental Laboratories. The results aze as follows; <br />I'a~ Spillway Emergency Spillway <br />TSS 36,000 mg/L 64 mg/L <br />SS 240 mg/L ND <br />Iron 400 mg/L 0.77 mg/L <br />According to the Memorandum of Understanding (MOU) between the DMG and the WQCD <br />dated February 9, 1994, DMG will be responsible for enforcing the requirements for design and <br />maintenance of water quality protection structures and minimize disturbance to the hydrologic <br />balance. The WQCD is responsible for enforcing CDPS permit conditions, including effluent <br />limitations. I have included a copy of the MOU for your reference. <br />The Division wrote a Notice of Violation (NOV C-97-015) to Seneca Coal Company for failure <br />to maintain the pond as per the design and passing runoff less than a 10-yeaz/24-hour event <br />through the emergency spillway. The primary discharge structure was plugged with debris, and <br />water was discharging through the emergency spillway. A copy of the violation is attached for <br />your reference. As noted in a letter from Seneca Coal Company neazly five inches of <br />precipitation occurred from September 18th to the 23rd. The emergency spillway sample was <br />collected in the morning of September 26, 1997 and the primary discharge sample was collected <br />at 2:00 p.m., roughly one hour after the spillway was cleaned by mine personnel. <br />
