File No. M-2000-016
Dear Mr. Mount:
III IIIIIIIIIIIIIIII
sss
For ~!Jlifi-
For Ptoplr
The following corutitute the conuttertts of the Colorado Division of Wildlilie. Mike Sherman (Field Habitat
Biobbrist) have reviewed this Rtxlametion Permit Application Consideration and made a field visit to the
proposed amended t-mte site on Apri126, 2000, and was accompanied by Pam Acre from Tuttle Applegate,
Inc.
We highly reconrmettd that the applicant maintain a mutimturt 200 foot setback from the South Platte River and
even rrore pret'etabie would be that the applicant tttauttain this setback from the edge of the riparian area abng
the River. Abng the River ate willows and old and large cottonwood trees. We highly recommend that aU of
these trees and the downfall be allowed to remain statding and intact on the site after the proposed project's
cort>pletion. These trees provide vahrable wildlife habitat on the site including peaches for roosting raptors and
cover for deer, rabbits, fox, wyote, skunks, tatcooq and reptiles. Ahhotrgh there is no evidence of raptors
nesting directly on the proposed mining srte (no nests currently observed), ntmterous raptor species may
potentia{ly nest in the cottonwood trees found on the property. Nou that the tnmutg site is within a designated
Winter Range of Bald Eagle, lured as Federally Threatenod, and u within the overall range of the Great Blue
Heron which breeds end feeds abng the South Platte River.
We observed an active black-tarred prairie dog town on the site. We reeommerd that the prarie dogs be eiit}rer
moved alive to another location or htrtttanely killed before any earth-moving occurs. Since Western Btttrowutg
Owls use prairie dog towers and live in prartie dog holes, the following shotild be observed:
- [f con9trvetion is to ocetu between March (and October 31, the area should be checked for the
prt;sence of btmowirtg owls prior to any earth-rmving taking place. The owls are sttsceptibk to being
btnied and killed in their holes by wnstruclion activity doming the nesting season.
- if cottsauction is done between November l end February 28, a is very tmhlcely that owls wouli be
presera since they migrate out of the state dtuing the winter.
DEPARTMENT OF NATURAL RESOURCES.
