Box 1105 Gunnison, Colorado 81230 Re: Schmalz Construction, Ltd. - "Hollenbeck Pit" - File No. - 5-023 Gunnison County - "Hollenbeck Pit" - File No. M-84-153 Dear Mr. Schmalz: I have received and reviewed the performance warranty for Schmalz Construction's "Hollenbeck Pit". With the addition of "SE 1/4" to the beginning of the legal description on page 4 of this warranty, it s adequate. I made this slight addition and have thus accepted the erformance warranty. Unless I hear from you to the contrary, I will assume t at this minor addition meets with your approval. Therefore, enclosed please find two signed original permits for th s operation. Please sign each permit in the space indicated, having your signature notarized, in each case. Then, retain one permit for yo r files and return the other to us within two weeks. This will complete the p rmitting process for this operation. Please be advised that all of your original application materials, as well as any subequent adequacy submissions from you, are considered an int gral part of your permit and are incorporated by reference. It is presumed hat you have a copy of all of these materials; therefore, none is enclosed with this mailing. Be further advised that each year, on the anniversary date of your permit, you must submit a X50.00 annual fee and an annual report that updates son the progress of mining and reclamation over the previous year and the laps for the next year for this operation. Although we attempt to send out a request for these items, it is your responsibility to submit them. The submittal of your complete warranty package and the issuance o a permit to your company meets the final requirements for release of all th reclamation responsibilities of Gunnison County for the Hollenbeck Pit permitted under file number M-84-153.
