Lung <br />date: January 14, 2002 Divivon Direrloi <br />This review is conducted to determine compliance with Rules 4.05.9(14)(15) and (17) <br />Reports are to be submitted quarterly and annually. The subject reports (combined) were <br />submitted on January 4, 2002 and received at the Division on January 7, 2002. That the report <br />was a combined report was confirmed with the operator by telephone on January 14, 2002. <br />Rule 4.05.904) All hnpoundments shall be inspected by a yua/ified registered profes.rionu/engineer <br />or other qualified professionnl specinlist under the direction of n professional engineer. The <br />professionnl engineer or specinlist shell be e.xperierrced in the construction of impounds+ents. <br />The inspection was performed by an authorized (qualified) professional specialist under the direction <br />of a professional engineer (John A. Schallenkamp, see cover letter of January 4, 2002). <br />Rule 4.05.9(14)(x) Such inspections steal/ be nrnde regu[nrly during construction, upon completion <br />of corrsh'uction, and at least yearly until removed of the strrrcnre or release of t/re performance <br />bond. <br />With regard to this rule, this is a yearly report. <br />Rule 4.05.9(14)(b) The qualified registered professional engineer shall, pronrpthr offer each <br />inspection required by 4.05.9(/4), provide to the Division, n certified report tint the impoundment <br />has been constructed nrzdlor nrnintnined «s designed, curd hr accordance with the approved plan and <br />the applicable regulations. <br />No certification was found in the report that the impoundment had been maintained as designed in <br />accordance with the approved plan and applicable regulations.
