Mr.
Thompsoa's letter descnbed the ponds ae being properly maintained and operational prior to the rainfall. Rainfall was
recorded at the mine site the afternoon ofthe discharges. Sampling was conducted on August 29, 2003 for Outfa11008A and
September 5, 2003 for Outfall 007A. A tea-year, 24-hour event at New Elk Mine is approximately 2.9 inches. Your
sediment ponds are dasigaed to contain a 10.year/Z4-hour precipitation event.
