Cottony <br />Division Director <br />Natural Resou¢e Trustee <br />RE: Adequacy Review, Phillips County Rafert Pit, IlOc Application, File No. M-2004 052 <br />Dear Mr. Schafer: <br />The Division of Minerals and Geology has received your application for the Rafert 110c Pit. <br />Listed below are the Division's adequacy review comments for this application. The Division is required <br />to make a decision no later than September 10, 2004, therefore, your response to the following adequacy <br />review concerns should be received by the Division by September 8, 2004 to give us time to evaluate your <br />responses. <br />1. Exhibit D -Reclamation Plan <br />Under Exhibit E Reclamation Plan, it is stated that the topsoil stockpile will be protected by seeding, <br />and that the reclamation plan includes replacing the topsoil. Please provide the Division with a seed <br />mix and rate of seeding to be used on the stockpile, and the depth of topsoil which will be replaced on <br />the site. <br />2. Weed Control Plan <br />Rule 3.1.10 (6) of the Minerals Rules and Regulations requires the use of weed control measures under <br />certain conditions. Please provide the Division with an appropriate weed control plan which will be <br />used for this site if weeds become a problem.. <br />3. As noted in the Division's August 12, 2004 "Receipt of Application" letter sent to you, "You must <br />submit proof of the notice and mailings....... to the Division of Minerals and Geology prior to the <br />decision date." Please send a proof of the publication of the notice and the notice mailings. <br />4.
