This letter is in response to your letter dated 25 February 1980, requesting
an inspection and written determination of Section 404 requirements for
Three Bells Ranch Associates, strip mining, located in parts of Section
11, 12, 13 and 14, Township 6 North, Range 68 West, Larimer County,
Colorado.
An on-site inspection was made 13 March 1980, by Mr. Robert Shields and
Mr. Jack Holm, Three Bells Ranch Associates; Mr. Don Bogart, Colorado
Division of Wildlife; and Mr. Micheal Freel and Mr. Del Broers of my
staff.
The inspection revealed that there was one wetland in existence located
in Section 13 (see inclosed map). Wetlands are marked in red.
Mr. Shields indicated that gravel extraction would be taking place in
this area. The material would be stockpiled out of the wetland area,
and he had no intentions of placing any fill material in this area.
Accordingly, a Department of the Army permit pursuant to Section 404 of
the Clean Water Act will not be required provided the activity does not
involve the filling of the wetland area.
