N,esccrces <br />This letter is in response to your letter dated 25 February 1980, requesting <br />an inspection and written determination of Section 404 requirements for <br />Three Bells Ranch Associates, strip mining, located in parts of Section <br />11, 12, 13 and 14, Township 6 North, Range 68 West, Larimer County, <br />Colorado. <br />An on-site inspection was made 13 March 1980, by Mr. Robert Shields and <br />Mr. Jack Holm, Three Bells Ranch Associates; Mr. Don Bogart, Colorado <br />Division of Wildlife; and Mr. Micheal Freel and Mr. Del Broers of my <br />staff. <br />The inspection revealed that there was one wetland in existence located <br />in Section 13 (see inclosed map). Wetlands are marked in red. <br />Mr. Shields indicated that gravel extraction would be taking place in <br />this area. The material would be stockpiled out of the wetland area, <br />and he had no intentions of placing any fill material in this area. <br />Accordingly, a Department of the Army permit pursuant to Section 404 of <br />the Clean Water Act will not be required provided the activity does not <br />involve the filling of the wetland area. <br />
