Nolan, MD, MPH <br />Exennive Director <br />This letter responds to your May 6, 1993, letter requesting the inactivation of the CDPS permit for the Grassy Creek <br />Mine. <br />We cannot grant this request at this time. The inactivation procedures that apply to coal mining facilities are derived <br />from the federal regulations governing the Coal Mining Point Source Category (40 CFR 434). These regulations <br />specify that limitations must be met 'until SMCRA bond release". The regulations further define bond release in <br />pertinent part, as "the time a[ which the appropriate regulatory authority re[ums a reclamation or performance bond <br />based upon its determination that reclamation work... has been sa[isfaclorily completed (40 CFR 434.11(d)). <br />We are aware that the Rockcas[le Company has forfeited their bond to the Colorado Division of Minerals and <br />Geology (CDMG). The CDMG has stated that although reclamation is progressing, it has not yet reached the point <br />where they are fully satisfied that the site has been returned to premising conditions. Once this goal has been <br />achieved, the site would meet the intent of the federal regulation and inactivation of the permit could occur. <br />Therefore, we require documentation from the CDMG at the appropriate time stating that they are satisfied that the <br />site is at premising conditions before we can inactivate this permit.
