Sherman <br />Exewtive Director <br />(Vacant/ <br />State Engineer <br />We have received your letter dated January 10, 2007 requesting renewal of a <br />substitute water supply plan for a sand and gravel pit operated by RBK Construction <br />(RBK). The applicant shall be responsible for compliance with this plan, but the State <br />Engineer's Office may also pursue the landowner for eventual compliance. The required <br />fee of $257 for the substitute water supply plan has been accepted as receipt no. <br />3613321. <br />PLAN OPERATION <br />No ground water was exposed in this pit prior to January 1, 1981. A 4-acre pond <br />exits on the site and has well permit no. 57014-F, Well Id. No. 1406563. No mining or <br />diversion of water for operations is anticipated for this plan year; however, this plan is <br />necessary to replace evaporation depletions. You have stated that the applicant may <br />resume mining of the site if additional replacement water can be obtained. This plan <br />must be amended before any other diversions of water occur or mining is resumed. <br />DEPLETIONS <br />You have provided a table showing the net evaporation caused by the pit is <br />14.40 acre-feet. (See Table Ij The pit is approximately 500 feet from the Arkansas <br />River and causes lagged depletions. The lagged depletions are also shown on Table I <br />and amount to 14.08 acre-feet for this plan year. <br />REPLACEMENT <br />Replacements will be provided by a 5-year lease that expires on March 31, 2010 <br />for 21 acre-feet of water that RBK has contracted with the Lower Arkansas Valley Water <br />
