Performance Warranty Request -for Construction Material Operations that do not Require a
Financial Warranty

On December 10, 2001, the Division of Minerals and Geology approved your 112c permit application. The conditions [o the
approval are noted below:
Slipu(ation No. 1
The operator must submit a copy of [he fully executed lease with the landowner (State Land Board) as a demonstration of the
basis for legal righC of entry to the site to conduct mining and reclamation operations. Final approval will not occur until the
Division receives a copy of lease.
Slipu(ation No. 2
Prior to conducting any blasting at the Indian Spriggs Pazk Pit, the operator will submit and receive approval fora
Geotechnical Stability Exhibit in accordance with Rule 6.5(4) of [he Construction Materials Rules and Regulations of the
Colorado Mined Land Reclamation Board.
In additional to compliance with stipulation # 1, you must submit a performance warranty in order for us [o issue a permit. We
have enclosed a performance warranty form with this letter for your use. Please have the performance warranty signed by an
appropriate official, notarized, and return it to us.
PLEASE NOTE THAT MINING OPERATIONS MAY NOT COMMENCE UNTII. A PERMIT HAS BEEN ISSUED
BY THE DIVISION AFTER RECEH'T OF YOUR PERFORMANCE WARRANTY AND COMPLIANCE WITH
STII'ULATION NO. 1. A PERMIT CANNOT BE ISSUED UNTIL WE HAVE VERIFIED THE ADEQUACY OF
YOUR PERFORMANCE WARRANTY.
