Cattany <br />Division Director <br />Natural Resource Trustee <br />First quazter 2004 reports have not been received in the DMG office. Based upon the Division's check of <br />records at the [nine site first quazter 2004 sediment pond inspectons were conducted 3/23/2004. Inspection <br />reports need to be sent to the Division on a quarterly basis in accordance with Rule 4.05.9(17). Please <br />forward a copy of the sediment pond inspection as soon as possible. <br />Second quarter 2004 reports have not been received in the DMG office. Please forward copies of the second <br />quarter 2004 sediment pond inspection reports to the Division as soon as possible. <br />Third quazter 2004 reports were received in the DMG office on October 21, 2004. Sediment pond <br />inspections were conducted on 8/25/2004. No significant concerns were noted in the pond inspections. All <br />ponds were dry except 5-P5, 5-P6, 5-P7, 9-P2, 9-P3. No discharge was recorded for any of the outfalls <br />during this third quarter inspection. RAG-EC/BTU Empire has been cooperating with DMG-AML group <br />on an underground mine fire mitigation effort at the Wise Hill No. 3 mine area. Mine water is being utilized <br />in this AML project. No maintenance items aze listed on the 3~ quazter sediment pond inspection reports. <br />Fourth quarter 2004 Sediment Pond reports were received by DMG on October 26, 2004. Sediment pond <br />inspections were conducted by RAG-EC on 10/20/2004. Fourth Quazter 2004 reports were submitted in a <br />timely fashion in accordance with Rule 4.05.9(17). Most of the ponds were dry with the exception of small <br />pools of water in 9-P2 and 9-P3, and the mine water treatment ponds; 5-P5, 5-P6, 5-P7. Only Outfall 003 <br />was discharging. The only maintenance item identified on these sediment pond inspection reports was <br />badger holes on 9-P6 needing repair. No other problems were noted fot this quarter. <br />Please submit the first and second quarter 2004 sediment pond inspection reports to the Division as soon as <br />possible.
