The Division <br />has approved his request and asks for your assistance in this matter. <br />Additionally, he mentioned that there was a possibility of a change in the <br />operator/ownership of the mine. If this is indeed the case, I have included <br />in this package the recent changes to the Colorado Rules and Regulations for <br />Coal Mining, as they pertain to the Transfer of Ownership and Identification <br />of Interests. Also enclosed are copies of the Request for Transfer of Coal <br />Permit and Succession of Operators that you will need to process, if there is <br />a proposed change. <br />As noted in the Division's January 8, 1991, letter to you, the following items <br />still need to be resolved prior to July 31, 1991, to preclude forfeiture of <br />the bond. <br />1. Designs for permanent stream channel, diversions and collection <br />channels associated with the excess spoil disposal area that meet <br />100-year, 24-hour storm event criteria pursuant to Rules 4.09.1(5) <br />and 4.09.2(7). (Reference tdined Land Reclamation Division letter <br />to Pioneer Engineering dated January 4, 1991.) <br />2. Demonstration of right of entry pursuant to Rule 2.03.6(1) and <br />Section 110(2)(j) of the Act. <br />
