Nielsen <br />General Manager <br />American Soda, L.L.P. <br />2717 County Road 215 <br />Parachute, Colorado 81635 <br />DENVER, CO 80202-2466 <br />JUL. 12 ~ <br /> <br />RE: UNDERGROUND INJECTION CONTROL (iJIC) <br />Class III Solution Mining Well <br />Final Permit Decision <br />UIC Appeal Nos. 00-1 & 00-2 <br />EPA Area Permit C03858-00000 <br />Rio Blanco County, Colorado <br />Dear Mr. Nielsen: <br />On June 30, 2000, The Environmental Appeals Board (EAB), United States <br />Environmental Protection Agency, issued a ruling on the request (LJIC Appeal Nos. 00-1 & 00-2) <br />by three petitioners, the Sierra Club, IMC Chemicals, Inc., and Tom Dodson and Associates, for a <br />review of the Final Area Permit C03858-00000. In the ruling, the EAB issued an order denying <br />review leaving the permit as issued. Lryou have not received a copy from the EAB and wish a <br />complete copy of the order, please contact Paul S. Osborne at (303)-312-6125. <br />Pursuant to 40 CFR 124.19 (f), a Final Permit decision shall be issued by the Regional <br />Administrator (or delegate) when the Environmental Appeals Boazd issues notice to the parties <br />that the petition for review has been denied. Accordingly, the UIC Area Permit No. 003858- <br />00000 dated February 9, 2000, is effective. As specified in the Permit, the effective date was <br />March 10, 2000. <br />As a reminder, Part II Section F. (1) ofthe permit requires that the established standby <br />trust must be updated to include the additional amount required to plug and abandon all new wells <br />prior to commencement of any new well construction. The amended bond must be filed with the <br />Region VIII Financial Responsibility Coordinator prior to any new well construction. In addition, <br />injection activities may not commence until "Prior to Commencing Injection" conditions found in <br />Part II Section C.
