The project is <br />located in Section 35, Township 40, Range 15, MDBSM, Dolores <br />County, Colorado. <br />Based on the information you have provided, it appears that <br />your proposed work will not involve the discharge of dredged or <br />fill material into waters of the United States. Therefore, a <br />Department of the Army Permit is not required for this work. <br />Measures should be taken to prevent construction materials and/or <br />activities from entering any waters of the United States. <br />Appropriate soil erosion and sediment controls should be <br />implemented onsite to achieve this end. <br />This determination is contingent upon your letter dated <br />April 7, 2006. According to the enclosed aerial photograph, <br />there area approximately 2 or 3 areas that could be considered a <br />waters of the US within your project site. Please ensure that <br />your activity does not impact these areas. If the project should <br />impact a waters of the US, you must notify this office to receive <br />the proper approvals. You are now considered aware of our <br />program. A violation of Section 404 of the Clean Water Act would <br />be penalized. Penalties may include fines up to $27,500 per day, <br />or imprisonment. <br />Please refer to identification number 200675107 in <br />correspondence concerning this project.
