Kelleyt <br />Thin latter is being sent to you at the direction of the Mined Lead Bacla- <br />mation Board regarding your concern over truck traffic which will serve <br />the Durham Saad and Gravel operation. Oa March 22. 1978. the I~fined Land <br />Beclamatloa Board approved the Durha Sand sad Gravel application, but not <br />without considerable debate over your obiaction which you filed with the <br />Board . <br />The Board in its decision concluded that grounds for denial of or alteration <br />of Durban Sand sad Gravel's application did not axiat for the following <br />reason: <br />1. That portion of the access road which was not included is the application <br />did not need to be included as affected lands within the permit area. <br />2. That the Board moat not interfere with the local zoning processes which <br />designated specific acceea roads as the only legal enerq to the mine <br />site. <br />The staff also reported to the Board that they haA discussed in detail with <br />the Weld County Comtniesion the access problem and its final solution, and <br />die covered that the Commission made its decision after significant public <br />input and due consideration. The staff also reported on discussions they <br />held with 9tatn Highway personnel familiar with effects of traffic as building <br />stability. Appnrenily State Highways personnel felt that structures located <br />on sand sad gravel should sot experience damage due to traffic induced vibrations <br />from closely located roads. <br />In concluding its consideration of the mat tar, the Board directed an explana- <br />tion of its action be sent to you, Mra. Kelley, end to let you knew that the <br />Mined Land Baclenation Board duet dose not feel that it is the proper forum <br />for consideration oP local soning matters. <br />If you have any questions regarding this matter, please do not hesitate to <br />contact this office. <br />Sincerely. <br />C.
