I will use the same numbering system used in <br />your letter and answer the paragraphs in order. <br />1. The Exhibit C map has been revised to show property lines for <br />all adjacent property owners. The numbers on the map <br />correspond to the list of property owners within 200 feet. <br />All manmade structures as well as the name of all roads, <br />buildings, oil and gas wells and lines, and power lines within <br />200 feet of all boundaries of the affected are labeled on the <br />map. New maps are enclosed. <br />2. The existing house located along the southern boundary in the <br />western half of the site is the building in question. This <br />house is owned by 83rd Joint Venture and may be used as a <br />storage area, office, or night watchman quarters. Neither <br />residences on the SE and SW corner nor any of their accessory <br />structures will be adversely affected by the mining. <br />Therefore compensation agreements will not be submitted. <br />3.(a) We will receive a zoning approval from the Weld County <br />Commissioners which will contain a site map showing a 25 <br />foot setback from the right-of-way of F Street. This <br />approval will serve as the County's approval of mining to <br />this setback. This hearing is set for October 21, 1992. <br />(b) Both Bellwether and the railway have legal rights-of-way <br />or easements in which they operate. The width of these <br />easements is to insure they have enough room to operate <br />and maintain their facilities in addition to offering a <br />safe setback from encroachment.
