We believe that it is not appropriate to include ofF site well mitigation within the <br />permit boundary for the following reasons. <br />1. It is a common practice for gravel operations throughout the State to mitigate groundwater impacts <br />to ofFsite wells. I have spoken to several operators who have drilled new wells, created off-site <br />recharge ponds andlor directly augmented into well casings. It is our understanding that none of <br />these operations were required to include those oif-site properties into their permit boundaries. <br />2. It is not appropriate to include the off-site properties in the mining boundaries. We have been <br />proactive in trying to predict off-site groundwater impacts and in working with well owners to enter <br />into agreements to protect them. None of the weH owners that i have spoken with want any portion <br />of neither their residential properties nor their farms encumbered by a mining permit. <br />3, Off-site well mitigation is regulated by other entities. Any disturbances associated with the <br />mitigation plans will be addressed in.private agreements with the off-site landowners, The State <br />Engineer's Office is responsible for groundwater administration and enforcement. They will review <br />and approve the proposed temporary substitute water supply plan and associated welt permit and <br />the augmentation plan for the project. The Colorado Department of Public Health and <br />Environment, Water Quality Control Division will regulate water quality through the site's Colorado <br />Discharge Permit System permit. We are required to obtain permission to cross any easement or <br />rights-of--way from its owner. For example, the City of Fort Lupton would have to approve any <br />proposed piping under Weld County Road 27 or any of the other roads adjacent to the property. <br />Please call me if you have any questions about this information.
