(3031 83? 8106 <br />October 30, 2000 <br />Mr. !oe Gagliano <br />Barnhart Agency <br />212 W. 13ih St. <br />Pueblo, Co 81003 <br />RE: Pino Pit (File M-2000-I 18) Review of applicant response to Division's adequacy review <br />Dear Mr. Gagliano: <br />The Division has completed its review of your response to the Division's initial adequacy review of the permit <br />application For the Pino Pit and has identified [he remaining adequacy issues: <br />PERFORMANCE AND FINANCIAL WARRANTIES: These required wartanties have not yet been <br />provided For the application. <br />Although the permit application may eventually receive approval from the Division, a permit will not be <br />issued for this operation until acceptable Performance and Financial Warranties aze received by the Division. <br />NOTICES: The Division will accept the evidence of notice of the application being received by Ernest <br />Shafer and of the attempt to notify Ed Pino as required by Rules 1.6.2(1)(e)(i) and (ii). The Division will also <br />accept the public notice as provided, however, the evidence that it was published according to the schedule <br />indicated has not been submitted. <br />The applicant must provide evidence that the public notice required by Rule 1.6.2(1)(d) has been <br />published the required number of times. <br />~~ <br />DIVISION OF <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING•SAFETY <br />BJI Owens <br />Governor <br />Greg E. bVal~her <br />Etecunve Director <br />Michael B. Long <br />Drv~sion Director <br />EXHIBIT C (Rule 6.4.3(g)): The Division will accept that Ed Pino owns the fences located within 200 feet <br />east and north of the azea to be affected by the proposed operation. The owner of the road that lies outside of the <br />affected area but still within 200 feet of it, however, has still not been identified. This is a road that will be used by <br />the applicant to access the operation and to haul material from it. <br />The applicant must identify the owner of the road that lies within 200 feet of the area to be affected by the <br />mining operation. <br />EXHIBIT L (Rule 6.4.12): As a result of the agreements made with the Division in regard to changes in <br />the proposed mining plan and our discussion of the results of your subsequent re-evaluation of the cost of <br />reclamation based on those changes, the Division will accept your revised estimate of the cost of reclaiming the <br />disturbance associated with the proposed mining operation. <br />The applicant must provide a financial warranty totaling S 115,400.00 in acceptable form in order that a <br />permit be issued for the proposed mining operation. <br />EXHIBITS (Rule 6.3.18): The Division will accept the compensation agreement provided by the <br />applicant to cover damages to the two fences owned by Ed Pino. However, the applicant has not identified the <br />owner of the road lying within 200 feet of the area to be affected by the proposed mining operation and has not <br />satisfied the requirements of this Rule for that road. <br />
