I am sure you are aware of some of the <br />uncertainties involved in the 404 permit program these <br />1 days. Our original concern was that wetlands may be <br />t=~ involved and we did not want to be accused of filling <br />:rl.~. in a wetlands. The applicant would much prefer to have <br />.,Yi+•~'~ a two cell system as it maximizes water storage on the <br />property. Therefore, we have placed the dike back in <br />the mining plan with the understanding that we will <br />obtain a 404 permit only if it is necessary and any <br />wetlands issues will be dropped. Based on this <br />commitment, the adequacy concerns discussed in the <br />remainder of 6 are addressed. <br />11. The spillway dimension in the lateral berm would be 350 <br />+ feet. <br />12. The length of pond perimeter that would be overtopped <br />would be approximately 800 feet. The flow in this area <br />is overbank and would spread out. Considering that the <br />entire area would already be under water during a major <br />flood, this perimeter area would have no potential for <br />offsite damage. The reclamation plan shows the <br />approximate direction that flow would travel during a <br />major flood. <br />16. A change in a well permit may be required if a <br />different aquifer is drilled into. C & M would have to <br />obtain this permit. <br />17. A copy of the agreement is enroute to you. This <br />adequately addresses item 17. <br />18. Enclosed is a revised Exhibit L. We will commit to the <br />15°s if it is going to be a standard line item that is <br />required of all operators. <br />This should cover all adequacy concerns regarding Platte Valley <br />Pit.
