Dear Ms. Ericksen:
On page 2, item 10 of the Regular (112) Operation Reclamation Permit Application
Form, two items were checked because both future (Post-mining) land uses are
considered primary by the operator and landowner of the property. After reviewing the
Construction Material Rules and Regulations, I could find no guidance as to how to
define "primary." Both uses are of equal importance in planning the reclamation, and
intended to support each other. Also, we were concerned that if both uses were not
identified, then potential opponents to the operation would challenge the reclamation
permit based on the fact that only one was identified as "primary." Therefore, we chose
to identify both as "primary" rather than check only one.
