No other Outtalls <br />discharged during the period. Outtall 003A flowed during the last two weeks of September. As discussed in our telephone <br />conversation and follow-up email of September 12, 2006, a ruptured pipeline containing a coal fine slurry from our wash plant <br />filled the Outtall 006 pond and resulted in some fines migrating downstream along Foidel Creek. The break was detected and <br />turned off on the morning of September 11, 2006. Outfall 006 may have started discharging on September 6`" or 7'", and <br />stopped flowing by September 23rd. Flows listed on the attached DMR are our best estimates based upon typical slurry <br />pipeline flows and observed flow levels after slurry was removed from Outtall 006 weir channel. Attached is a copy of the <br />memo discussing the even[, that was sent to you via email. Cleanup up of the site has been completed in consultation with <br />the Colorado Division of Reclamation Mining and Safety. <br />Outtalls 005W and 007W did not flow during the period. Therefore, Quarterly Whole Effluent Toxicity (WET) testing was not <br />conducted for these sites. <br />In order to reduce the amount of paper work, the following certification will be substituted for the actual DMR forms to cover <br />the outfalls, which did not discharge. These outfalls include ponds T (OutfaO 002A), C (Outfall 004A), D (Outfall OOSA and <br />OOSW), F (Outtall 007A and 007W), and G (Ouffall OOSA). Note that ponds A (Outtall 001 A), and H (Ouffall 009A) have been <br />deactivated following bond release, and have been removed from the newly amended permit, effective January 1, 2003. Also <br />note that Outfall 020A has not been constructed yet. <br />I certify under penalty of law that I have personally examined and am familiar with the information submitted herein; and <br />based on my inquiry o/ those individuals responsible for obtaining the information, I believe [he submitted information is <br />true, accurate, and complete. I am aware that there are significant penalties forsubmitting false information, including the <br />possibility of fine and imprisonment. See 18 U.S.C. § 1001 and 33 U.S.C. § 1319.
