Elk Creek Mine. <br />Dear Ms. Watson: <br />Enclosed are the January 2005 Discharge Monitoring Reports (DMA's) for the Oxbow Mining, <br />LLC, (OMLLC) Elk Creek Mine. <br />The enclosed DMRs indicate discharges from Outfalls 012 and 016 which exceeded the primary <br />effluent ]imitations for total suspended solids (TSS) and total iron. Tn accordance with the <br />October 24, 2004 Permit Amendment No. 1, Permit Part II Alternate Limitation Burden of Proof <br />Requirements, the request for relief of primary total suspended solids (TSS) and total iron <br />limitations are attached herein for the Division's consideration. Due to discharges caused by <br />precipitation from a series of less than 10-year, 24-hour precipitation event(s), OMLLC is <br />requesting a determination of compliance with the permit "Alternate Limits." <br />Please note that the text of 014-A is mis-printed because of an apparent printer mechanical <br />problem.
