est Color <br />Geotechnical /Environmental Engineering • Materials Testing <br />Subject: Man- Mine -Permit No. G80-006 <br />Permit No. C-80-006 <br />Jackson County, Colorado <br />Dear Mr. Bumell: <br />Division of Reaamanon, <br />Mining anJ Saiety <br />NWCC, Inc. is pleased to provide you with the certified sediment pond inspections for the Marr <br />Mine located in Jackson County, Colorado. Under the supervision of Brian D. Len, P.E., Robert J. <br />Peterson from NWCC Inc. conducted the inspection on October 30, 2006. The purpose of the <br />inspection was to provide annual certification by a Professional Engineer registered in the state of <br />Colorado. The inspection included Ponds A, B, D, E and F for the mine area and the pond situated <br />at the Tipple. Note that ponds C and G were reclaimed during the summer 2006. The inspection <br />forms are attached for each pond and the results of the inspection are summarized below. <br />Photographs taken during the inspection are available upon request. <br />All ponds, embankments and spillways were functioning as designed and intended. All ponds <br />contained water. Ponds D, E and the Tipple pond were nearly full. No water levels were at the <br />designed point of discharge but some discharge was observed at the Tipple pond weir. This was <br />likely due to seepage from the nearby irrigation ditch, which was flowing. We observed both sides <br />of each embankment, the crest, the primary and emergency spillway structures, the outlet pipes, <br />weirs and discharge areas for each pond. There are no actions required for any pond for <br />immediate health or safety concerns. For long term maintenance, we have made <br />recommendations for several action items associated with the 5 ponds remaining at the mine. <br />These are all considered permanent ponds (Ponds A, B, D, E) or have been recom ded for <br />permanency (Pond F). The recommendations were made to maintain or improve the f n 'on and <br />safety of the dam/pond and are noted on each pond inspection fonn.
