III III III IIIIIIIIII Permit No. N79'2 <br />• PtINED LAND RECLAMATION B0 <br />999 ,Department of Natural Resources <br />1313 Sherman Street, Room 723 Telephone: 839-3567 <br />Denver, Colorado 80203 <br />DEVELOPPtENT A:VD EXTR4CTION MINING PERPIIT <br />THIS PEFI~fIT is issued this <br />Reclamation Board, Department of <br />IJHEREAS, Corn Construction <br />operation, kno~~~n as NORTH DELTA <br />mined sand E gravel; and <br />11th day of April, 1979 by the Mined Land <br />Natural Resources, State of Colorado. <br />IJ I T N E S S E T li <br />:ompany desires to conduct a(n) open mining <br />PIT for the purpose of extracting open <br />IJHEREAS, on January 5 , 19 79, Corn Construction Company "FILED" an <br />application,a reclamation plan and map, and the required fee, as required by law; and <br />WHEREAS, on March 2] ~ 1g 79, the Ptined Land Reclamation Board approved <br />THE NORTH DELTA PIT application and set bond; and <br />WHEREAS, on April II 19 79, the i•Sined Land Reclamation Board accepted <br />surety submitted by Corn Construction Company and such date shall be considered the <br />date of issuance of the permit and [he anniversary date for alp other purposes; and <br />[JHEREAS, [lie Plined Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that: <br />1) [he application complies with the requirements of the Colorado <br />'lined Land Reclamation Act and all applicable local, state and <br />Federal laws; and, <br />2) [he operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there <br />is an agreement between the operator and the persons having an <br />inter es[ in the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conformance with the requirements of C.R.S. 1973, 34-32-116, as <br />amended (1976 Sess. Laws H.B. 1060 ; and <br />41HEREAS, Eor the purposes of issuing this permit, the operator has made a <br />satisfactory showing to the Board that he will employ during and after his <br />open mining operations procedures reasonably designed to minimize <br />as much as practicable the disruption from the open mining operations <br />and will provide for the rehabilitation of the affected land through the rehabilitation <br />of plan[ cover, soil stability, water resources, and other measures appropriate to the <br />subsequent beneficial use of such mined and reclaimed lands; and that in the even[ <br />of the failure of leis proposed reclamation plan, he will take whatever measures which <br />may be necessary in order [o assure the success of reclamation of the lands affected <br />by his open mining operations; and, <br />WHERGIS, for the purposes of issuing this permit, a co)Sy of the application <br />approved by the dined Land Reclamation Board of the State of Colorado i.s attached <br />co this permit and thereby becomes a part of the terms hereof. <br />NOW, THEREFORE, pursuant to the authority set forth in the Colorado Mined <br />Land Reclamation Ac[, Article 32 of Title 34, C.R.S. 1973, as amended, (1976 <br />Sess. Laws lI.B. 1065) the ;tined Land Reclamation Board of the State of Colorado <br />hereby issues a life of the mine permit to Corn Construction Company to engage <br />in p en mining For the purpose of extracting o en <br />mined sand ~.
