Before a decision can be made on your application the following items need clarification. Please provide a <br />response to each item prior to June 10, 2002. If you aze unable [o fully respond to this letter, please contact me <br />requesting continuance of the decision to a later date. <br />Please be advised that your application may be deemed inadequate and denied on June 10, 2002 unless the <br />following adequacy review items aze addressed to the satisfaction of the Division. <br />EXHIBIT C -Mining Plan <br />1. Please state the range of depths of topsoil salvage for reclamation ptuposes. <br />2. Please clarify exactly what you mean by your statement "Reclamation of mined out premises will be ongoing <br />~o_~~ „_~,E~,..,,, ..~ .e .h.,., ,~ ~n ~ a ~ ,.. ,~n.~.,,._e~~~, ma>timu ; ~ttteunf e€ lattd~ ea , otll <br />have affected (disturbed) including all land affected by mining activities and reclamation activities but no[ ye[ <br />released by the Division from further reclamation responsibility? <br />3. You listed several recorded easements but told me on the phone, eazlier today that only one -Southeast <br />Colorado Power Association's easement is within 200 fee[ of your proposed permiUaffected land boundazy. <br />Please confum that statement in writing. <br />EXHIBIT S -Permanent Man-made Structures <br />4. You stated in Exhibit S [hat "there aze no permanent man-made structures located on or within 200 feet of the <br />proposed west affected land". However, the Southeast Colorado Power Association has a power line within 200 <br />feet of the proposed west affected land boundazy. Please provide a notarized statement from [he power company <br />that the mining and reclamation activities as proposed will have "no negative affect" on [heir power line.
