Dept. of Natural Resource <br />Enclosed please find four (4) sets of revised material for our Mesa Gravel Pit permit <br />expansion. As you are aware, the reason for resubmittal of this material is due to an <br />adjacent land owner's request. That request being the alteration of the mining plan <br />which, in brief, entails the cessation of mining after 12 years to preserve the original <br />drainage patterns. Peabody Coal Company (PCC) will continue to strive to work out an <br />agreeable mining and reclamation plan with all parties involved in order that someday <br />mining may proceed beyond year 12. <br />The major changes you'll find on the enclosed maps and narrative are changes that result <br />from cutting back the permit area. The original permit area requested a total of 93.7 <br />acres wd now has been revised to 36.3 acres. This area is shown on the maps as being <br />that area east of a line labeled as A-A'. Portions of the application have not been <br />changed to reflect the new permit area. There are two reasons for this, first, in the <br />interest of time both for CMLR and PCC, it was decided that a complete rewrite and <br />redrafting of all the maps would be a very time consuming exercise. Secondly, as pre- <br />viously stated, PCC would like to work out the problems with the mining plan. With this <br />in mind, major portions of the mining and reclamation plan would again have to be re- <br />vised asecond time to address the complete permit area (i.e. soils, vegetation, hy- <br />drology). Therefore, for the present, disregard any reference to mining and reclamation <br />after year 12, or beyond Line A-A'. <br />The initial application fee for the 93.7 acres was $1,240.00, now that we have reduced <br />the area to 36.3 acres the fee should be $605.00.
