On Au ust 23 1989. the Mined Land Reclamation Board of <br />the Colorado Department o Natural Resources (the "State") approved an <br />application fora mining operation under 34-32-101 et seq. from <br />C b M Companies, Inc. addre55 P,0. box 490, Niwot, CO <br />80544 f"Applicant") and assigned <br />Permit Application Number M-89-056 <br />B. The Applicant wishes to assign the approved Application to <br /> <br />Don Ke~hn Construction, Ync. . address 6322 South College Aire., <br />Fort c:ollins, co so525 . as Successor Applicant I"Successor") <br />and Successor wishes to become Successor Pertnittee after all requirements of <br />C.R.S. 34-32-101 et seq. are met and the permit may be issued.. <br />II, <br />AGREEMENTS <br />Applicant and Successor hereby agree, for their own benefit and for the <br />benefit of the State, such agreements to be effective ipso fac~o upon the <br />approval by the State of the transfer of the Application~ro~plicant to <br />Successor, as follows: <br />1, Successor has inspected the DroPosed site of the mining and <br />reclamation operations and is fully aware of the condition thereof. Successor <br />has e~;amined the Application for the permit and is fully aware of its contents <br />and stratus in the permitting process. Successor thus understands and accepts <br />the Application as it currently exists. <br />2, Successor understands the permit for this Application Cannot be <br />issued until all applicable requirements of C.R,S.. 34-32-101 et se.q. are net. <br />inclu<fing submission of adequate performance and financial wer`rantTes. <br />
