Long <br /> Division Director <br />Re: Colorado Gravel Products Inc., File No. M-1999-117, Objection Received to <br />Construction Materials Regular (112c) Permit Application. <br />Dear Mrs. McCormick, <br />On March 13, 2000, the Division received a FAX copy of your objection letter, dated March 8, 2000, <br />against the permit application named above. The letter was received before the end of the public <br />comment period. As such, your timely filed letter has initiated a process beyond the Division's normal <br />review for the application. The process may involve you as a "party" and may include holding several <br />conferences or hearings prior to any decision made on the application. <br />Please review the enclosed "Informal Conference Package" for more information regarding public <br />participation in the application review process and how to become a party if you so desire. If you decide <br />to become a party, we may conduct the Informal Conference and Pre-hearing Conference by telephone, or <br />by meeting at a location near Center, Colorado. (Thank you for including your telephone number.) We <br />will notify you regarding any details of these conferences. <br />Concerning the issues raised in your letter, and as you are already aware, State statutes do not give <br />authority to this agency to address topics such as impacts from dust, noise, defacement of the land, or <br />property values. The focus of the statutes related to this agency's review of permit applications and <br />issuance of permits is ensuring that mined areas be reclaimed to a beneficial use after the conclusion of <br />mining (pursuant to CRS 34-32.5-101 el seq.). <br />For information on issues related to fugitive dust or air quality, we recommend you contact the Air <br />Pollution Control Division at the Colorado Department of Public Health and Environment, telephone <br />number 303-692-3100. For information on noise, which is normally handled by local government <br />agencies, we recommend you contact the Saguache County Planning office. Issues such as "defacement <br />of land" (aesthetics) and impacts to property value are normally handled by local governments. We again <br />recommend contacting the Saguache County Planning office, to see if there are regulations in place to <br />protect property values. <br />If you decide to become a party to the permitting process, this Division will send you notification of the <br />time, date, and location of the Informal Conference and any other meetings that are held in this regard. In <br />order to obtain "party status", an objector must provide to this office as soon as possible a signed "Party <br />
