Box 459 <br />Florence, CO 81226 <br />Re: Marr Mine, C 1980-006, First and Second Quarter 2005 and Third Quarter 2006 Sediment Pond <br />Inspection Reports <br />Dear Mr. Patterson <br />The Division received Kerr Coal Company's (KCC) Third Quarter 2006 Sediment Pond Inspection reports <br />on December 5, 2006. Timely submittal of these reports is in compliance with Rule 4.05.9(17). Sediment <br />pond inspections were conducted by KCC on September 13, 2006. No problems were noted with any of the <br />ponds during the third quarter 2006 inspection. None of the ponds were dischazging. Pond C has been <br />reclaimed. <br />Review of the Division's records found First and Second quarter pond inspections for 2005 absent. Kerr <br />Coal company submitted the First and Second quarter 2005 pond inspection reports on December 5, 2006. <br />The ponds were inspected on Mazch 23 and 25, 2005 for First quarter 2005, and June 30, 2005 for the <br />Second quarter 2005. No problems were noted during the First or Second quarter 2005 inspections.
