It is stated in your October 9, 1990 response letter that a <br />200-foot setback will exist from the Lupton Bottoms Ditch, the <br />utility poles, the gas well, and the gas well support facilities. <br />Map C, however, seems to indicate that excavation will occur within <br />100 feet of the gas well and the ditch. The "Notes" on Map C, <br />additionally, state that the minimum setbacks from the gas well <br />facilities and the ditch will be 50 feet.' Map C also indicates <br />__ _ that topsoil and overburden will be stockpiled within 50 feet of <br />the utility poles. Map C also indicates that overburden will be <br />stockpiled within 25 feet of the property boundary south of the <br />Phase 1 Pit, while the "Notes" state that the minimum setback from <br />the property line will be 25 feet. Please address these <br />discrepancies. <br />2. Please verify that the Phase 1 Pit flood control outlets have been <br />designed for the 25-year/24-hour precipitation event. <br />3. We estimate that, as a result of mining plan changes, the total <br />affected land acreage will now be 50 acres. Do you concv r, and if <br />not, what will the total affected land now be? <br />You state that there will be very little pastureland left at this <br />site within the Perry property, and that the number of cattle <br />allowed to graze in the area will not be significant enough to <br />create bank erosion problems as discussed by the local Soil <br />Conservation Districts. Please state the number of cattle that <br />will be allowed to graze within this property once it is fully <br />reclaimed, and the amount of area within the Perry property that <br />will be used for grazing. Please also state whether the 4H:1V <br />cattle ramps will be constructed. <br />
