During this period, only ponds A (Ouffall 001), B (Outtall 003), D (Ouffall 005), and E (Ouffall 006) discharged to Foidel <br />Creek. No permit excursions were noted for this period. Outtall 001 discharged only during the weeks of September 17~ and <br />24~", which allowed for two samples to be collected and analyzed this month at this point. Outfall 003 discharged only during <br />the weeks of August 10'", 17'" and 24 '", which allowed for two samples to be collected and analyzed during this month. <br />Please note that the DMR forms we received for Outfall 001A include an erroneous parameter listing of total recoverable <br />manganese. This is not a required monitoring parameter under the permit, as such, a not applicable ("NA") symbol has been <br />inserted into the data entry areas for this parameter. <br />Quarterly Whole Effluent Toxicity (WET) tests were conducted the week of August 6, 2001 for Outtalls 001 and 005. Outfall <br />005 passed for both species, with "Concentrations with Statistically significant Difference in Lethality" reported at >100%. <br />Outtall 001 was not chronically toxic to the survival of C. dubia, but did not pass with regards to the reproduction of <br />Ceriodaphnia dubia, as well as to the growth and survival of fathead minnows. In an August 21, 2001 telephone conversation <br />between Mr. Chris Gates and myself, CDHPE agreed not to require Colorado Yampa Coal Company (CYCC) to initiate either <br />accelerated or PTIlTIE testing as a result of this WET test failure, since CDPHE was in the process of approving CYCC's <br />request to discontinue chronic WET lesGng and substitute acute WET testing for Daphnia magna only. A copy of a CYCC <br />letter to Mr. Gates (dated August 21, 2001), verifying the understanding of this conversation, is attached. Copies of the CDPS <br />WET Tesl Report Forms for these tests are included with this submittal. Please note that the new DMR forms we received for <br />reporting WET test results are missing one parameter, %Effect Startre 7 Day for Pimephalles Chronic TCP38, Code "P°. As <br />such, we modified an existing DMR sheet to input this missing parameter. The modified sheet is attached to the DMR with the <br />other WET test parameters. <br />Outtalls 002, 004, 008, 007, and 009 did not discharge; and therefore had no chemical tests during this period. Outfall 020 <br />has not been constructed yet; therefore there is no discharge to enable chemical testing to date. Points 010, 016 and 017 <br />have been eliminated from this permit. In order to reduce the amount of paper work, the following certification will be <br />substituted for the actual DMR forms to cover the outtalls, which did not discharge. <br />1 certify under penalty of law that I have personally examined and am familiar with the information submitted herein; and <br />based on my inquiry of those individuals responsible for obtaining the information, I believe the submitted information is <br />true, accurate, and complete. 1 am aware [hat there are significant penalties for submitting false information, including the <br />possibility o/ /ine and imprisonment. See 18 U.S.C. § 1001 and 33 U.S.C. § 1319.
