Please regard these comments as preliminary in nature. I will provide further <br />detailed comments as the review process proceeds and as I have had a chance to more <br />carefully analyze all potential Town impacts and recommend acceptable mitigating <br />measures. The Town Council will most likely also provide an official position statement <br />on the application in the next few weeks. If any additional application materials should <br />be submitted we would request copies be provided us. Also, please keep us apprised of any <br />scheduled hearing dates before your Planning Commission or Board of Commissioners. <br />The documents I have preliminary reviewed included the "Application for Mined Land <br />Reclamation Permit" and "Use by Special Review Permit, Douglas County" for the Winkler <br />Light Aggregate Quarry as submitted by Hallett Materials Company (June 1989). I have <br />attached two comment letters already sent to the Mine Reclamation Board expressing the <br />concerns of the Town Council and certain homeowner's association groups regarding the <br />proposed quarry operation and reclamation permit application. As you can see, one of <br />the major concerns centers on the new permit process established by S.B. 162 and the <br />subsequent loss of Town/County control once past the reclamation permit step -particularly <br />in regards to mitigation of offsite impacts. <br />I was much encouraged by our recent phone conversation in which you indicated that the <br />County would ensure that all land use, phasing, and off-site impact issues were adequately <br />addressed within the County's use by special review permit review process - a process <br />whose outcome continues to be independent of whatever land use/phasing assumptions may <br />have been implied in the pending reclamation permit.
