Simpson, P.E. <br />State Engineer <br />We have reviewed your letters of December 17, 2003 and December 29, 2004 requesting <br />renewal of a substitute water supply plan for a sand and gravel pit to be operated by RBK Construction <br />(RBK). The Applicants shall be responsible for compliance with this plan, but the State Engineer's <br />Office may also pursue the landowner, for eventual compliance. The required fee of $217 for the <br />substitute water supply plan has been paid. <br />PLAN OPERATION <br />This is a new pit, and no groundwater was exposed prior to January 1, 1981. However, a 3- <br />acre pond. currently exists on the site, permit no. 57014F. The site is to be wet mined with a mining <br />area water surface not to exceed 4.0 acres. It is anticipated that upon completion of mining, a <br />permanent free water surface of 4.0 acres will be exposed to evaporation in the pit. A permanent <br />augmentation plan will, therefore, be required. Mining is not anticipated for this years plan. <br />DEPLETIONS <br />You estimate the anticipated annual consumption to be 14.4 acre-feet of evaporative losses <br />from 4.0 acres of exposed groundwater. The anticipated losses are summarized on a monthly basis in <br />the attached table along with the lagged stream depletions. <br />REPLACEMENT <br />Replacements will be provided from a 5-year lease through March 31, 2010 of 21 acre-feet of <br />water RBK has contracted with the Lower Arkansas Valley Water Conservancy District of Larkspur <br />Ditch water released from storage in Pueblo Reservoir and administered by AGUA. Consumption at <br />the pit will cause lagged depletions to the Arkansas River. Based on stream depletion modeling, it <br />appears that 90 percent of the total consumption at the pit will be lost from the stream in the first year. <br />RBK proposes to make full replacements to the Arkansas each year in the amount of the actual <br />consumption at the pit. <br />
