Contractor shall start excavation at face of existing pit and excavate <br />in a south and westerly direction, not to exceed the area indicated on <br />' the attached map nor exceed the depth of the present pit, <br />2. Location of contractor's equipment including crushers, scales and batch <br />plant shall be discussed with owner prior to start of operation and any <br />future relocation. <br />3. The owner shall have first right of refusal to purchase any surplus of <br />crushed material at the same price charged the highway department. <br />4. One cent per ton or 1.5 cents per yard of the agreed royalty of 16 cents <br />per ton and 24 cents per yard shall be considered as compensation for <br />White River Aggregates, Inc. to effect the reclamation of this operation. <br />S. Provisions shall be made to protect owner's livestock, <br />6, The contractor shall pay the property owner for all materials removed. <br />Payment therefore shall be in monthly installments; each monthly payment <br />shall be based upon the quantity included in the Department's progress <br />estimate for the preceding month, and the same shall be made on or before <br />the ZOth day of each month. The contractor shall retain ten (10) percent <br />of the money due the property owner until final yardage or tonnage is <br />determined by the Department. <br />7. Topsoil overburden will be removed and hauled to area indicated on attached <br />map and stockpiled for final reclamation. Sagebrush to be piled for burning <br />is a designated area. <br />8. Trash disposal area during construction period shall be designated by owner. <br />No off-spec material shall be left or burned on leased area but placed in <br />an area designated by owner. • <br />9. Any roads, other than ones designated by owner, shall be removed and seeded <br />also. <br />10. The owner will assume responsibility of the Land Reclamation Board permit <br />at the expiration of this option. • <br />11. It is to be noted that Aztec Redi-Mix Inc. is in adjacent pit area. <br />!2.
