It will be reclaimed to crop land per the wishes of the landowner. The road <br />base will be removed from the underlying topsoil and the 1.5 acres encompassing the temporary <br />access road will be returned to crop land; no reclamation seeding will be performed in this area. <br />In response to your slurry wall questions, we offer the following: <br />We intend to investigate by drilling, sampling and lab testing the soils adjacent and below the <br />excavation. We will develop a set of drawings and specifications that will be certified by a <br />registered engineer, and submit them to the SEO for approval. We will submit a copy of the <br />approved plans to the Division for your files. It would appear that between the policy memo by <br />Bruce Humphries dated March 29, 2000, and your bond calculation dated March 23, 2000, that <br />no other information is required. We hereby request that you condition our permit on the <br />receipt of the SEO's letter of approval in your office. We anticipate that we will be complete <br />with the design and review by September, 2000. <br />Our plans for filling the reservoir are confidential. We have sufficient junior water rights and <br />shares of the Lupton Bottom Ditch Company to fill the reservoir when we have completed our <br />mining operations. <br />Your discussion of slurry wall costs is very illustrative, if only to dramatize the high cost of <br />installing civil construction for the federal agencies noted. We stand by our $3.00 per square <br />foot estimate and consider it very conservative. We will gladly share our calculations with you <br />once the design is approved by the SEO. <br />We feel that the submittal of slurry wall drawings and specifications, which have been certified <br />by a registered engineer, and the subsequent approval by the SEO, should demonstrate full <br />compliance and entitle us to a 20% bond.
