LOnR <br /> Division Dvecror <br />RE: Highway 291 Pit (Permit N1-77-195) Staves oFcompliance problems identified in report of D ivision's <br />inspection on 2/3/99 <br />Dear Mr. Barnhart: <br />As a result of you letter dated March 30, 1999, the Division has altered the status of certain of the above <br />referenced compliance problems as follows: <br />Compliance Problem I (Adequacy of financial warranty): The Division has not completed its re- <br />evaluation of the adequacy of the $5,000.00 financial warranty currently posted for the pit. As a result of <br />your letter of March 30,1999, the Division does understand that Hard Rock Paving and Redi-Ivtix is <br />proposing that all of its local 6.17 acre property be included in the recognized permit area for the Highway <br />291 Pit. The Division wtll proceed with its re-evaluation of the financial wartan[y based on that <br />understanding and will advise you of its determination following completion of the re•evalualton. While <br />there is no corteclive action date set for [his compliance problem a[ this point, the matter is not yet <br />resolved. <br />Compliance Prnblem 2 (Water seepage and potential ponding in the pit): The Division will accept <br />your report of the source of the water in question and that its future management will not require that the <br />mining andlor reclamation plans fur the pit be modified. This problem has been vacated- <br />Compliance Problem 3 (Supplementary information required for 1997-98 Annual Report): The <br />Division will accept your report of mining activity in the pit during the 1997-98 year as zvidence that the <br />period of inactivity at the site did not exceed a year. In such case, [he reporting of a cessation date For <br />activity, etc. in the annual report for the year does not appear tD be necessary.
