Walther <br />Executive Director <br />Michael B. Long <br />Division Duector <br />Recently amended Rule 4.05.9(14) requires anaooual inspection and P.E. certification of all <br />impoundments. This annual inspection and certification report is in addition to the quarterly impoundment <br />inspections required by 4.05.9(17). Please initiate the annual inspection and certification no later than <br />the 1" Quarter, 2002. The quarterly pond inspection report form currently used by BME is certified by a <br />P. E., but the form does not contain the necessary statement indicating that each impoundment has been <br />constructed and maintained in accordance with the approved plan and the applicable regulations. <br />In addition to initiating the annual impoundment certifications, please review carefully the revised <br />impoundment regulations, and submit any additional design documentation or modifications needed to <br />demonstrate compliance with Rules 4.05.6 and 4.05.9, within the same timeframe. <br />Please contact me if you have any questions. <br />Since ely, <br />~-s~~ <br />Dan T.
