P 319 472 227 <br />pF Cp~ <br />~~ R <br />„~% \e <br />•~• <br />~tBr6~ <br />Colorado Deparunent <br />of Public Htnlrh <br />and Environment <br />The Division of Administration of the Colorado Department of Health through the Water Quality Control <br />Division issued a Notice of Violation and Cease and Desist Order ("NOV&CDO") to Trinidad Basin Mining Co. <br />on December 15, 1992 for violations of the Clean Water Act. <br />In letters dated February 3, 1993, March 18, 1993, and May 3, 1993, the Division advised you of our intent [o <br />seek a civil penalty of $(1,136 for the violations cited in ttte NOV&CDO. In the most recent two letters, the <br />Division indicated the petition for imposition of [his penalty would be filed if you failed to contact us within ten <br />(10) days. The penalty petition was not previously executed following that time period because we were awaiting <br />legal review. Any further delay is no longer necessary, so this will be the final extension of this offer. Please <br />advise me within ten (]0) days after receipt of this letter as to whether you wish to meet with the Di~:sion to <br />discuss this matter. Should the Division not hear from yott within the ten (10) days, we will file the civil penalty <br />petition. <br />We look forward to hearing from you regarding this matter.
