We have received your letter of August 18, 2006, requesting renewal and amendment of the
above referenced substitute watersupply plan to coverdepletions caused by an existing gravel mining
operation. The required fee of $257.00 for the renewal of this substitute supply plan has been
submitted (receipt no. 3608011). The original supply plan was approved on September27, 2004 and
the plan was most recently renewed on January 9, 2006.
Plan Operation
The mining plan includes a slurry wall around the perimeter of the site during mining.
The slurry wall has been completed, however, recent tests have indicated that there is a leak in
the liner. 120t" Estates Partners is currently working to fix the slurry wall and anticipates that the
slurry wall liner will be fixed and approved prior January 1, 2007.
All mining will be accomplished using a dry mining method. The plan includes a rinse
water lagoon and dewatering pond contained within the slurry wall with a combined exposed
surface area of 2 acres. Other consumptive uses at the site include dust control and water
removed in product.
Water pumped from the dewatering pond will be discharged into the Henderson Water
Ski Lake ("Ski Lake"), a reclaimed and unlined gravel pit. Evaporative losses from the Ski Lake
are augmented under division 1 Water Court case no. 82CW393. According to the plan and
based on site observations of the Ski Lake, no significant increase in evaporation wilt occur from
the lake as a result of discharging water to the Ski Lake.
