III IIIIIIIIIIIIIIII 999 BLUE MOUNTAIN ENERGY, INC. Spill Prevention, Control and Countermeasure Plan HISTORY OF SPILLS There have been no reportable spills at the Deserado Mine in the last 10 years. The only reportable spill occurring on the site was in 1986 when approximately 1500 gallons of hydrochloric acid was released due to a faulty valve. Appropriate actions were taken to minimize contamination and to clean up the site following the spill. There were no notable long-term impacts. Secondary containment was enlarged to allow full containment of similaz occurrences in the future. RESPONSIBLE FACILITY MANAGEMENT The Mine Manager, Safety Manager, appropriate Supervisor and Envirorunental Engineer will be notified as soon as a leak or spill of any hazardous material is found. The source and cause of the spill or leakage will be defined and appropriate action taken to minimize additional releases and environmental damage. The period of the event will be defined as to date, time and duration. Steps will be taken to identify the cause of the leak or spill, the nature of the product, where the leak or spill originated, where the product could migrate, health hazards: etc. A Spill Report Form (Attachment 1) is to be filled out by the responsible parties. Action will then be taken to prevent a recurrence of the event. Action to be taken will be based on the type, quantity and nature of product involved. The goal would be to contain the event and prevent damage to adjacent areas on or off site. These actions may include, but are not limited to: 1. Dikes or berms 2. Absorbent booms 3. Diversion ditches leading to containment 4. Available neutralizing agents 5. Absorbent agents AGENCIES TO CONTACT IN CASE OF REPORTABLE SPILL STATE WATER QUALITY CONTROL DIVISION The State Water Quality Control Division will be notified within 24 hours after a leak or spill is found. A written report will be mailed within 5 days. The source and cause of the leakage or spill will be defined and, if possible, actions will be taken to prevent a reoccurrence. The 6122198
