Your letter included a record of <br />river and climatological observations which verified a rain event that occurred from April 26 through April <br />27 in which you reported an accumulation of 1.38 inches of rain resulting in a discharge on April 27, <br />1999. Trapper Mining has demonstrated that discharge occurred within 48 hours of measurable <br />precipitation, discharge was beyond your control, and that the pond's volumes prior to the storm event <br />were greater than the 10-year/24-hour storm volume.
