LAFARGE <br />RECEIVED <br />MAR 2 92002 <br />March 28, 2002 <br />Division of Minerals and Geology <br />Dr. Berhan Keffelew <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Re: Adequacy review Comments M-2002-009, Beeman #1 and Proof of mailing for the <br />adjacent property owners <br />Dr. Berhan Keffelew: <br />Response to your review comments for the 112 sand and gravel application. <br />EXHIBIT "A" Legal Description (6.3.1) <br />I) The Site appears to be in Section 19; however, the detailed legal begins in Section 18. <br />The point of beginning for the legal description begins in Section 19 and references back <br />to a known monument point in Section 18; however, the Site itself is located in Section <br />19. Mangini and Associates, Inc. surveyed the Site in 1998 and provided the legal <br />description for the application. The survey and Mangini's legal description aze attached <br />as Exhibit A. <br />2) The Mine Plan and Mine Plan map shows a portion of the Site to be in Section 18. <br />As seen in the survey, the section line for Section 18 and 19 is not a direct east-west line <br />and has an approximate 6-degree southwest bearing. The north property boundary <br />follows the Section 18 and Section 19 section line, therefore, the Site lies is entirely in <br />Section 19. The Section line on the Mine and Reclamation Plan drawings incorrectly <br />follow a direct east-west bearing. <br />EXHIBIT "C" Pre-mining and mining plan maps of affected lands (6.4.3) and EXHIBIT "S" <br />Permanent and Man Made Structures (6.4.19) <br />1) The operator is required to show the owner's name, type of structures and location of <br />all significant, valuable and permanent man made structures contained on the affected <br />land and within two hundred feet of the affected land.
