Dept oilVatural Resources RE: Permit Application, Lee Doughty, File No. 75-9 Dear Mr. Lucas: After reviewing the information available concerning Mr. Doughty's,open pit clay mining operation, we have determined that the existing clay extraction activities and pits are legal nonconforming uses within the Agricultural-Two (A-2) Zone District upon the subject property. Thus, continued clay extraction activities are legally permissible though not in conformance with the zoning so long as skid operations are pursued in compliance with. Section 2$ of the Jefferson County Zoning Resolution. The following restrictions on this legal nonconforming uses should be, of particular note to you. Firsts the use o£ this property established as leclal is limited to clay extraction. The extraction is restricted to the annual amount of clay extraction which has been ee;ti- mated at the 10-12 thousand ton level per year. No nepr pits may be started on the property and thE~refore continued extraction is limited to an expansion of they two existing pits. Each of these pits are within an area of mining operation of approximately two acres. These areas are generally described on the map attached hereto.
