Box 116 <br />Springfield, Colorado 81073 <br />III IIIIIIIIIIIII III <br />999 <br />Re: McVey Pit - File No. 78-226AL <br />Dear Mr. Humphrey: <br />I have received your application for a limited impact, 110 permit for <br />the McVey Pit (now permitted as a 111 operation to the Colorado Division <br />of Highways). This application is now considered as complete and is <br />scheduled for consideration by the Mined Land Reclamation Board during <br />the April 27-28, 1983 meeting. I have enclosed a complete form letter <br />giving this same scheduling. <br />Although the publication for two sequential weeks was not exactly as per <br />the format suggested on the back of the complete letter, our Division <br />Director, David C. Shelton has said that these publications should be <br />considered adequate, given the existing nature of the pit. Please send <br />our Division a copy of the publisher's affidavit as proof of these publications, <br />however. <br />I have one question concerning the adjacent landowners, Mr. and Mrs. H.E. <br />Ming. They were not mentioned during the original application process. <br />~/ Presumably, they own land immediately adjacent to the affected land. Please <br />'/~` clarify this matter. Also, if the McVey's still own the area of the affected <br />land, they must be notified, and proof of the notification (certified mail <br />return receipt) should be sent to our Division. <br />The second special permit application for this site stated that the Division <br />Hof Highways would mine all remaining material. Obviously, this did not <br />occur. How much of the permit area remains to be mined, and where will the <br />remaining mining occur? 4lhat is the expected life of this 110 operation? <br />Please note that I have added "L" to the permit (or file) number. This denotes <br />the fact that a 110 application has been filed on the site.
