Cottony <br />Division Director <br />Natural Resource Trustee <br />At approximately 1 I :00 on 9 October 2007, Tony Tennyson of the Colowyo Coal <br />Company called to inform the Division of an exceedence of the total suspended solids <br />limit for the Streeter Pond at the Colowyo Mine. Tony stated that the water sample was <br />taken on 25 September 2007 and sent away for laboratory testing, and that the laboratory <br />results were just received by Colowyo. <br />Tony stated that the discharge was the result of a storm event that occurred over the <br />previous weekend (22-23 September 2007). He also stated that he had contacted Kelly <br />Morgan of the Colorado Department of Public Health and Environment's Water Quality <br />Control Division {CDPHE-WQCD) to report the exceedence and to request relief from <br />the limit due to the discharge being a result of a storm event within 48-hours. <br />The call from Tony Tennyson of CCC fulfills the requirement of Rule 4,05.13(2)(a)(ii), <br />requiring that the Division be notified "within 5 days after analytical results of the sample <br />collections indicate that noncompliance with a permit condition or applicable standard <br />has occurred."
