Messner <br /> J-Bar-B, Inc. <br /> 1805 Kipling Street <br /> Lakewood, Colorado 80215 <br /> Re: Bailey Pit - File No. M-84-099 <br /> Dear Mr. Messner: <br /> On August 23, 1984 the Colorado Mined Land Reclamation Board approved the above <br /> referenced permit with stipulations and with financial warranty set at $73,000.00. <br /> The Stipulations are as follows: <br /> 1 . THE UNBACKFILLED HIGHWALL OF THE EXCAVATION CANNOT EXCEED 1000 FEET IN <br /> LENGTH AROUND THE PERIMETER. <br /> 2. THE MAXIMUM UNRECLAIMED DISTURBANCE ON SITE CANNOT EXCEED 77 ACRES. IN <br /> ADDITION, THE MAXIMUM ACREAGE FOR AREAS TO BE REVEGETATED CANNOT EXCEED 36 <br /> ACRES. <br /> 3. THE MINED LAND RECLAMATION B RECOMMENDS THAT ALL MINE OPERATORS <br /> CHECK COMPLIANCE OF THEIR MINING O ERATION WITH STATE WATER LAW. IF MINING <br /> COMMENCES WITHOUT PRIOR COMPLIANCE WITH APPLICABLE STATE WATER LAWS, THE <br /> STATE ENGINEER MAY TAKE INFORCEMENT ACTION. <br /> For clarification, it is the operator's obligation to minimize impacts to the <br /> environment as a result of the mining operation. In accordance with Mr. O'Brian's <br /> letter of August 22, 1984, material form the concrete and/or asphalt batch plant <br /> will not be disposed of on site. Also, stockpiled topsoil will be protected from <br /> erosion or damage. Finally, any material other than riprap to be used as erosion <br /> protection along St. Vrain Creek should be approved by the Division prior to use. <br /> Familiarity with the permit and with the law will assist the operator in <br /> maintaining compliance during mining. <br /> In order to complete the permitting process the performance warranty and financial <br /> warranty for the operation must be submitted by the operator and approved by the <br /> Division. Rule 7 of the Regulations explains the types of financial warranties <br /> available.
